This is the privacy notice (“Privacy Notice”) for the WiseOx AI platform and services offered by Bacon AI Inc. (the “Company,” “WiseOx,” “we,” or “us”). This Privacy Notice describes our practices with respect to Personal Information we collect from or about you when you use our website, AI offerings, and other services (collectively, our “Services”). Please read this Privacy Notice carefully to understand how we collect and use your information. We may provide additional notices about our privacy practices, each of which will be considered to form part of this Privacy Notice. If you have questions about our privacy practices or would like to make a complaint, please contact us at accounts@wiseox.com.

YOU CONSENT TO OUR PRIVACY PRACTICES BY INDICATING YOUR CONSENT WHERE THE OPTION IS MADE AVAILABLE OR USING OUR SERVICES IN ANY MANNER. Your use of our Services is subject to this Privacy Notice and our Terms of Service, including its applicable limitations on damages and the provisions regarding resolution of disputes. If you do not agree with this Privacy Notice, do not access or use our Services.

AI Mascot end users should contact the operator of the website or platform for privacy support. WiseOx clients and prospective clients may contact WiseOx at accounts@wiseox.com or by phone at 971-266-0334.

1. AI Mascots Offered by WiseOx Clients. This Privacy Notice does not apply to data collected through any third-party website or platform, including those operated by a client of the Company, or the use of your data collected by one of our clients through an Artificial Intelligence Mascot created via the Services (“AI Mascot”). Such data processing and related privacy practices are governed by the client’s privacy notice and policies, not ours. Additionally, WiseOx data processing to train our generative AI technologies or develop AI Mascots for our clients is governed by our customer agreements covering access to and use of those offerings, not this Privacy Notice. 

2. Which data is Personal Information? As used in this Privacy Notice, “Personal Information” information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual consumer or device, such as:

  • Identifiers (e.g., name, email, telephone number, address, username);
  • Sensitive Personal Information (e.g., government identification number; precise geolocation; racial or ethnic origin; religious beliefs; health information; contents of messages when we are not the recipient; in some cases, information about a known child);
  • Legally protected information (e.g., race, citizenship, marital status, sex);
  • Employment-related information (e.g., current or past employment);
  • Non-public educational information, including information protected under the Family Educational Rights and Privacy Act (20 U.S.C. § 1232g, 34 C.F.R. Part 99);
  • Biometrics (e.g., DNA, face/voice prints, health data) and audio, electronic, visual, thermal, or olfactory information;
  • Commercial information (e.g., products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies);
  • Internet or other similar activity (e.g., browsing history; content interactions); and
  • Inferences drawn from Personal Information to create a profile about preferences, characteristics, trends, predispositions, behavior, attitudes, intelligence, and aptitudes.

Note that information may not be protected by privacy laws if it is: (i) publicly available (ii) aggregated, meaning data about a group or category of services or users from which individual identities and other Personal Information has been removed; or (iii) deidentified so that it cannot be easily linked back to the individual.

3. Children’s Privacy. AI Mascots and our other Services are designed for use by adults, not children. If a WiseOx client permits children to interact with their AI Mascot, that client does so according to its own privacy practices, not ours. Please contact the client with any questions about children’s privacy.

WiseOx does not knowingly collect Personal Information from children under 16. If we discover that a child under 16 has provided us with Personal Information, we will delete their information from our systems. If you believe we might have any information collected online from a child under 16, or if you become aware of any unauthorized submission of information to WiseOx, please contact us at accounts@wiseox.com.

4. WiseOx Collection and Use of Personal Information. We only collect, use, retain, and disclose Personal Information as described below, and only as reasonably necessary and proportionate to provide the Services or for other purposes stated in this Privacy Notice or at the time of collection. WiseOx collects identifiers, commercial history, internet, and similar activity as described below, and we may also collect any other categories of Personal Information that an end user of an AI Mascot chooses to include in a prompt or other input (“Inputs”). We collect this information from clients and their end users as well as prospective clients with their consent, with a legitimate interest, or as authorized or required by law.

  • Your account creation and activities. If you create an account with WiseOx as a client or to use our Services, we will collect details to create and facilitate your account including identifiers like your name, email, phone and other contact information, and login credentials. We will also collect data related to Services purchased and transaction history on the Services associated with your account. If you incur fees with us, we will use a secure payment processor to collect and process your payment information as needed.
  • Your use of the Services. When you use WiseOx Services, we collect the Personal Information contained in any data you provide to us, such as your file uploads and other client data, or data included in your Inputs. We also collect log data, usage data, and data collected from cookies and related technologies, some of which may qualify as Personal Information under privacy laws. We collect this data with a legitimate interest, and we use it to provide and improve our generative AI technologies and other aspects of our Services and facilitate client and end user use of AI Mascots.
  • User interactions with AI Mascots. If you create or interact with an AI Mascot on a client’s website or via the Services, we will collect any Personal Information you include in your Inputs. WiseOx uses the Personal Information and other data contained in user Inputs as a service provider to the client for which we provide the AI Mascot to generate the requested content outputs (“Outputs”) and to provide and improve the AI Mascot. WiseOx may also use this data in our own capacity for our legitimate interest in training and improving our generative AI technologies or for analytics and statistical purposes. As part of our commitment to client and user privacy, WiseOx does not process any Personal Information in a manner that would make it available to other users or clients, whether through an AI Mascot or otherwise. By interacting with an AI Mascot, you consent to this collection of your information for these purposes. Any use of Inputs or Outputs by a client is subject to the client’s privacy practices, not ours. WiseOx has no liability for the use of any Input or Output by a client, user, or any other party.

When you submit Inputs to the Services, whether on a client website or the WiseOx website, WiseOx will collect and record any information, including Personal Information, that you choose to include in your Inputs. YOUR INPUTS AND INTERACTIONS WITH AN AI MASCOT MAY BE ACCESSIBLE TO WISEOX OR OUR THIRD-PARTY SERVICE PROVIDERS SIMULTANEOUSLY AND IN REAL TIME. By interacting with an AI Mascot, you consent to this access to your Inputs and Outputs by WiseOx and our service providers. If you do not consent to such access, you should not interact with the AI Mascot.

  • Your communications with WiseOx. We collect the Personal Information contained in your communications with WiseOx, whether through email, chat, or through our social media channels.
  • Directly from you when you visit the WiseOx website or communicate with us. When you visit the WiseOx website, use the Services, or communicate with us through email, chat, an online form, by phone, our social media channels, or other means, we collect identifiers like your name, email address, and other contact information. We collect this information with your consent, and we use it for the purposes stated at the time of collection, to provide you with the Services you request, and to communicate with you or send you direct marketing communications.
  • From clients as their service provider. Clients of WiseOx that collect technical data about user interactions with the client’s AI Mascot or website may share that data with us. We may combine this information with other data to gather feedback about our Services and to run reports on behalf of the client. We only use this data as permitted by our contract with the client or as permitted by law. Note that our clients may use this data and any other data or Personal Information the client collects as the client wishes, which may include delivering interest-based (behavioral) advertising or other targeted content. Please contact the client if you have questions. WiseOx is not responsible for the privacy practices of any of our clients or any third party.

In addition to the specific uses described above, WiseOx may use Personal Information to (i) provide, administer, maintain, improve, or analyze the Services; (ii) communicate with clients or others; (iii) develop new Services, products, or features; (iv) prevent fraud, criminal activity, or misuse of the Services, and protect the security of our information systems, architecture, and networks; (v) comply with legal obligations or protect our rights and the rights of others, or (vi) support or carry out a business transition or transfer.

5. Disclosing Personal Information. WiseOx discloses Personal Information to certain third parties to achieve our business purposes as described below, with your permission, or as required by law. In the preceding 12 months, we have disclosed Personal Information from all categories of collection to one or more of the following recipients:

  • Our Service Providers. WiseOx uses a variety of service providers such as data storage providers, analytics services, and email services. The type of information that we disclose to a service provider will depend on the service that they provide to us. Our service providers are subject to contractual agreements that protect your Personal Information, and we require all service providers to maintain confidentiality standards that are commercially reasonable to ensure the security of your Personal Information.
  • Aggregated and Deidentified Information. WiseOx may de-identify or aggregate any Personal Information or other data input to or collected through the Services. De-identified and aggregated data is not Personal Information and we will not attempt to reidentify it with any consumer except as required by law. We may use this data to analyze the effectiveness of the Services or improve the Services, such as train our language learning models, improve or add features, or for research or related purposes. We reserve the right to disclose aggregated and de-identified data to third parties without limitation.
  • WiseOx does not sell your Personal Information. WiseOx does not disclose Personal Information to third parties in exchange for monetary or other valuable consideration.
  • WiseOx does not share your Personal Information. We will not share your Personal Information with third parties for cross-platform marketing purposes.
  • Law enforcement, and other governmental agencies, as permitted or required by law.
  • Other third parties, as permitted by applicable law, for example: if we go through a business transition (e.g., merger, acquisition, or sale of a portion of our assets); to comply with a legal requirement or a court order; when we believe it is appropriate in order to take action regarding illegal activities or prevent fraud or harm to any person; to exercise or defend our legal claims; or for any other reason with your consent.

6. Retention of Personal Information. We retain the Personal Information we collect about you for the minimum period necessary to provide the Services to you, or for other legitimate business purposes such as resolving disputes, security reasons, or complying with our legal obligations. Each client determines the retention period for Personal Information included in their end users’ Inputs that the client collects through an AI Mascot. Please contact the client offering the AI Mascot for details. WiseOx will delete Inputs as instructed by the client.

If you contact us to request customer support, we will delete your Personal Information after responding to your inquiry. If you apply for a job with WiseOx, we only keep your application and related materials until the position is filled unless you ask us to keep your materials on file for future job openings. When we no longer have a business need for your Personal Information, we will either delete, de-identify, or anonymize it whenever feasible. Where not feasible (such as data in our backup archives) we will securely store it and keep it isolated from further processing until it can be permanently deleted. Clients may retain Personal Information collected through their AI Mascot for different retention periods, subject to the client’s privacy practices.

7. WiseOx and Cookies. WiseOx uses cookies on the Services for functionality, analytics, security, and marketing purposes. Cookies are alphanumeric identifiers that we transfer to your device’s hard drive through your browser. Session cookies allow our systems to uniquely identify you during a session or while you are logged in. They exist only during an online session and disappear from your device when you close your browser or turn off your device. Persistent cookies track aggregate and statistical information about user activity and remain on your device after you have closed your browser or turned off your device.

We use cookies to recognize your device and to store your preferences. Some third-party cookies allow us to collect information about your online activities over time and across third-party websites. The cookies we use on the Services include:

Most web browsers automatically accept cookies. You can adjust your browser options to block or disable cookies or to notify you when a cookie is sent to your device. Most browsers offer a Help tool that will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. You can also install third-party plugins to control cookie behavior.

8. Your WiseOx Privacy Controls. WiseOx provides you with options to access and control how we collect and use your Personal Information on our Services. If you have interacted with an AI Mascot provided by a WiseOx client, please contact the client to learn about your privacy controls. 

  • Your Account. You can access, correct, update, or delete certain Personal Information on your account by logging in and saving your changes or adjusting your settings. If you require assistance or want to revoke a consent you previously gave us, please contact accounts@wiseox.com.
  • Emails. We may send you support emails related to your account or, if you opt-in, we will send you marketing emails. You can unsubscribe or change your preferences via the links provided in the emails or send a request to accounts@wiseox.com. If you opt out of marketing emails, we will still send support emails related to your account.
  • Device Settings. You can control the data we collect through cookies and related technologies by adjusting your device settings or your cookie preferences on the website.
  • Block Location Tracking. You can stop all collection of information by an app by uninstalling it. You can also reset your device Ad Id at any time through your device settings, which is designed to allow you to limit the use of information collected about you. You can stop all collection of precise location data through an app by uninstalling the app or withdrawing your consent through your device settings.
  • Texting. If you provide your wireless number, you consent to WiseOx sending you service text messages. However, we will only send you marketing text messages if you opt in. The number of texts you receive will depend on the Services you use and the information you request from us. You can unsubscribe from our text messages by replying STOP or UNSUBSCRIBE to any of these text messages. Messaging and data charges may apply to any text message you receive or send. Please contact your wireless carrier if you have questions about messaging or data charges.
  • Do Not Track. Do Not Track signals are signals sent through a browser informing us that you do not want to be tracked. Currently, our systems do not recognize browser “do-not-track” requests.
  • Privacy Requests. Depending on where you live, you may have specific rights under consumer privacy laws. Please see our supplemental notices below. If you wish to exercise your privacy rights, or if you want to express concerns, revoke your consent, lodge a complaint, or request information, please contact WiseOx at accounts@wiseox.com.

WiseOx can only assist with or fulfill a privacy request when we have sufficient information to verify that the requester is the person or an authorized representative of the person about whom we have collected Personal Information, and to properly understand, evaluate, and respond to the request. We do not charge a fee to process or respond to a verifiable request unless we have legal grounds to do so. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We endeavor to respond to privacy requests in accordance with the requirements of the law applicable to your jurisdiction. If we do not fulfill your request within the legally required timeline, you can appeal our response by contacting accounts@wiseox.com.

9. Notice of Privacy Rights. For those in the United States, consumer privacy is governed by federal privacy laws covering specific industries or data uses and more than a dozen state laws providing consumer privacy rights. For users in Canada, the Personal Data Protection and Electronic Documents Act and other provincial privacy laws give Canadians specific rights regarding their Personal Information.

WiseOx users in the European Union and the United Kingdom are protected by the General Data Protection Regulation and its UK counterpart regulation, each of which data subjects to control whether and how their Personal Information is collected and used by businesses. WiseOx collects and processes the Personal Information of data subjects as a processor when users interact with a client’s AI Mascot and as a controller to website visitors and users of AI Mascots and other Services offered through the WiseOx website. Additionally, Australia, as well as many countries within the continents of Africa, South America, and Asia, have enacted comprehensive consumer privacy laws offering a broad spectrum of consumer rights over their Personal Information.

The privacy rights typically available under these various laws are listed below. To exercise your privacy rights relating to an AI Mascot provided by a client of WiseOx, please contact the client directly. WiseOx will support your exercise of these rights as applicable and subject to exceptions and limitations. 

  • Right to know. You have the right to know how WiseOx collects and processes your Personal Information. We have provided the required notices in this Privacy Notice. We may provide you with additional notices through the Services or update this Privacy Notice from time to time.  other ways we process your Personal Information, such as by sending you a notice via email or by other means of communication.
  • No selling or sharing Personal Information. WiseOx does not sell Personal Information or share Personal Information with third parties for cross-contextual behavioral advertising or other marketing purposes.
  • Limited use and disclosure of sensitive Personal Information. WiseOx does not seek to collect sensitive Personal Information about anyone, and in no case will we use or disclose sensitive Personal Information for the purpose of inferring characteristics about a consumer.
  • Right to expect. You have the right to expect that we collect, use, and disclose Personal Information responsibly and as described in this Privacy Notice to which you have consented. WiseOx will also notify you of any changes and will request your further consent as required by law. You may withdraw your consent at any time with reasonable notice by contacting accounts@wiseox.com.
  • Right to accuracy and to correct. If you become aware that the Personal Information that we hold about you is incorrect, or if your information changes (e.g., change of name or address), please inform us and we will update our records.
  • Right to access. Upon request, we will provide you with a copy of your Personal Information, along with details about the types of Personal Information we process, why we process it, and any third parties we work with to collect Personal Information on our behalf. WiseOx may be legally prohibited from disclosing some of your Personal Information, and we may be limited in the number or frequency of requests we must fulfill. 
  • Right to opt-out of automated decision-making and profiling. Some AI Mascots may leverage generative AI technologies that process data in a manner that qualifies as automated decision-making or profiling under privacy laws. Each client offering an AI Mascot is responsible for this type of processing and for providing users with notice and a method to opt-out. Additionally, you can prevent your Personal Information from being processed in this manner by not engaging with AI Mascots that use automated decision-making or profiling.
  • No health data collected. WiseOx does not collect any health data, and we ask that you do not submit any health data to our Services through Inputs or otherwise. However, certain of our clients may collect health data through their AI Mascot. Some laws entitle consumers to certain details about health data collected about them, including confirmation of whether the entity collects, shares, or sells the consumer’s health data and access that data (including a list of all third parties and affiliates with whom the entity has shared or sold the health data and a method to contact those third parties), a method to withdraw consent related to use of health data, and the right to have their health data be deleted. Please contact the client to exercise your rights related to your health data.
  • Right to data portability. In certain cases, WiseOx may be required to provide your Personal Information at your request and in a structured and readily useable format.
  • Right to delete. You may have the right to request that WiseOx delete your Personal Information. Upon your request and where we are required to do so by law, we will delete your Personal Information that we collected and retained, with certain exceptions. We may permanently delete, deidentify, or aggregate the Personal Information in response to a request for deletion. Deleting your Personal Information may prevent WiseOx from providing you with the Services.
  • Right to object. Some users may have the right to request, under certain circumstances, that WiseOx limits our processing of your Personal Information as you request.
  • Right to restrict processing of your Personal Information. You may have the right to request that we restrict the processing of your Personal Information, for example, if the data is inaccurate, the processing is unlawful, we no longer need the Personal Information, or you exercise your right to object. Your right to restrict may be limited to Personal Information that is sensitive in nature, or that is sold or shared for certain purposes.
  • Right to nondiscrimination. WiseOx will not discriminate against you for exercising your privacy rights. For example, unless permitted by law we will not deny you goods or services, charge you different prices, provide a different level or quality of service, retaliate against you in an employment context, or suggest that you may receive a different price or rate because you exercised a right under applicable privacy laws.
  • Right to disclosure. Some privacy laws provide the right to receive details about a company’s collection and use of the consumer’s Personal Information. For example, you could request details about the categories of Personal Information we have collected about you or sources of collection, our business purpose for these activities, or the categories of third parties with whom we disclose that Personal Information. WiseOx does not sell or share your Personal Information, but if we did you could request lists of categories of buyers or recipients of your Personal Information.
  • Right to disclosure of marketing information. If you are a resident of the State of California, note that California’s Shine the Light Act (Civil Code sections 1798.83-1798.84) entitles California consumers to request certain disclosures regarding Personal Information sharing with affiliates and/or third parties for marketing purposes.

10. Consent to Cross-Border Data Transfers. WiseOx is a United States company using technical infrastructure in the United States. If you access the Services from outside the United States, please be aware that your Personal Information may be transferred to, processed, stored, and used in the United States or other jurisdictions. When your information is moved from your home country to another country, the laws and rules that protect your Personal Information in the country to which your information is transferred may be different from those of the country where you live. For example, if your information is in the United States, it may be accessed by government authorities under United States law.

WiseOx is committed to transferring Personal Information using a lawful data transfer mechanism. However, we do not warrant that the Services are appropriate or authorized for use in any other jurisdictions. Each client and user is individually responsible for determining whether their use of the Services complies with applicable laws. By allowing us to collect Personal Information about you, you consent to the transfer and processing of your Personal Information as described in this section.

11. WiseOx Data Security. WiseOx has implemented and maintains reasonable security measures to secure your Personal Information from accidental loss and unauthorized access, use, alteration, and disclosure. Data is stored in a variety of secured cloud environments. We use Google Cloud Storage for uploaded documents, MongoDB Atlas Cloud to store organization and session data, and Weaviate Cloud Services for managed vector databases. All data is secured using the AES-256 algorithm and SSL for end-to-end encryption at rest and transit. WiseOx personnel are required to follow security protocols and are trained to handle sensitive data. Data and systems are subject to regular backups and audits. Our service providers are contractually bound to adhere to the same security protections. WiseOx has policies and protocols in place to respond to security incidents in compliance with our customer agreements and applicable law.

Our security measures are appropriate to the volume, scope, and nature of the Personal Information processed and designed to meet our duty of care. However, WiseOx cannot guarantee the security of information transmitted over the Internet. You are responsible for keeping your account login information confidential and any data transmissions are at your own risk.

12. Third-party APIs. WiseOx does not use any user data or any other information obtained from third-party APIs such as Google Workspace APIs, Atlassian Confluence Cloud REST API, Microsoft OneDrive API, or Zendesk Help Center API to develop, improve, or train generalized AI and/or ML models.

13. Third-Party Services. The Services may provide access or links to services offered by third parties. Please note that WiseOx has no control over third-party websites, apps, devices, or systems, and you should exercise caution when deciding to disclose your Personal Information.

13. Updates to this Privacy Notice. WiseOx may update this Privacy Notice from time to time. We will notify you about material changes to this Privacy Notice by email or by other measures that are appropriate to provide you with notice. We will collect your consent to these changes to the extent required by applicable law.
